Wandvo Creator Agreement
Version 4 · Effective August 27, 2026
This Creator Agreement (the "Agreement") governs participation in Wandvo's monetization program (the "Program"). By accepting it, you (the "Creator") enter into a binding contract with Wandvo (the "Platform"). If you do not agree, do not enable monetization.
1. Relationship between the parties
- You are an independent contractor. This Agreement does NOT create an employment, partnership, agency or franchise relationship. You are not a Wandvo employee and receive no salary, benefits or workers' compensation.
- You must be 18 years of age or older and complete identity verification before receiving any payment. Where available, this verification is performed by Stripe Identity: you submit a government ID and a selfie directly to Stripe, which confirms your age and identity to us without Wandvo receiving or storing the document or selfie itself.
2. Virtual economy
- Coins 🪙 and diamonds 💠 are virtual items with a limited license for use inside the app. They are not money, deposits or financial instruments, earn no interest, and have no value outside Wandvo.
- When you receive virtual gifts, diamonds are credited to you according to your creator tier (a percentage of the gift's coin value). Current tiers, percentages and the conversion rate are shown in your Wallet.
- The Platform may modify coin prices, gift values, tier percentages and the conversion rate with at least 15 days' notice. Diamonds already accumulated are paid at the rate in effect when the withdrawal is requested.
3. Payments
- Withdrawals are processed in accounting periods with cutoffs on the 1st and 16th of each month (one request per period).
- Diamonds become withdrawable in the period after the one in which you earned them. In practice a gift takes between 7 and 24 days to become available, and your Wallet always shows how much you can withdraw right now. This waiting period exists so that a payment can be confirmed as settled before it is paid out — it protects you as much as the Platform, because money already paid out on a payment that is later reversed has to be recovered.
- A minimum and a maximum per period apply, visible in your Wallet. The Platform endeavors to pay within 5 business days after the period closes.
- Payment is sent to the method registered and verified in your name (PayPal, bank transfer, Stripe Connect, or other available methods). Where Stripe Connect is used, your bank account and the tax information Stripe requires to enable payouts are collected directly by Stripe's own onboarding flow — Wandvo only receives your account status, not your full bank details. Payment-processor fees may be deducted from the amount.
- You are responsible for keeping your payment details accurate. Payments sent to incorrect details you provided are not recoverable by the Platform.
4. Holds, reversals and fraud
- If gifts you received originate from fraudulent payments, chargebacks, stolen accounts or artificial activity (self-gifting, collusion, bots), the Platform may reverse the associated diamonds and hold or cancel pending payments.
- The Platform may hold a payment for up to 60 days to investigate suspicious activity, notifying you of the reason.
5. Taxes
- As an independent contractor, you are solely responsible for reporting and paying any taxes on your earnings in your jurisdiction.
- The Platform may request tax forms from you (for example a W-9 if you are a U.S./Puerto Rico person, or a W-8BEN if you are a foreign person) and report payments to tax authorities where required by law.
- If you receive payments via PayPal, Stripe Connect, or another processor, that processor may issue you its own informational forms (e.g. 1099-K or 1099-NEC) under applicable legal thresholds.
Tax documentation required before your first payment. To be paid you must provide us — directly or through Stripe onboarding — your legal name, address, date of birth, country of tax residence, and taxpayer identification number (TIN, VAT ID, or the equivalent in your country). Creators in the U.S. and Puerto Rico submit a W-9; creators outside the U.S. submit a W-8BEN (individuals) or a W-8BEN-E (entities). Without this documentation we cannot release the payment and, where the law requires it, withholding may be applied to the amount.
Reporting to your tax authority. If you reside in the European Union, the United Kingdom, Canada, Australia, or New Zealand, the Platform may be required to collect your tax details and report your earnings to the relevant tax authority (for example, under the EU DAC7 Directive and the equivalent OECD rules for platform operators). By accepting this Agreement you consent to that reporting, and you undertake to keep your tax details accurate and up to date and to notify us if they change. This data is handled in accordance with the Privacy Policy.
What happens if you don't complete your tax documentation. If, after two reminders, you have not provided the documentation required by this Section, and at least 60 days have passed since the second reminder, we may hold your pending payments or close your participation in the Program until you complete it. When we report your data to a tax authority under the paragraph above, you have the right to request a copy of what was reported.
Backup withholding and the country from which you provide the service (U.S.). If your taxpayer identification number is missing or cannot be validated, U.S. law may require us to apply 24% backup withholding to your payments. In addition to your country of tax residence, you must declare to us the country from which you provide the service (these can differ) and notify us if it changes; that information supports treating your income as foreign-source for purposes of withholding under the U.S. Internal Revenue Code (IRC §1441).
None of the above changes Section 1: there is no employment relationship between you and Wandvo, and you remain solely responsible for declaring and paying your own taxes. (Section added 2026-08-20.)
6. Content and conduct
- You must comply with the Terms of Service and the Community Guidelines. Monetization may be suspended for violations, without prejudice to other measures.
- You grant Wandvo a limited, non-exclusive license to use clips or screenshots of your public broadcasts to promote the app.
- Soliciting gifts in exchange for off-platform activities, sexually explicit content, or any illegal activity is prohibited.
7. Verification data
- To enable payments we collect: legal name, date of birth, country, identity document and payment-method details. They are used exclusively for verification, fraud prevention and legal compliance, in accordance with the Privacy Policy.
- Acceptances of this Agreement are recorded with date, version and IP address as contractual evidence.
8. Suspension and termination
- You may leave the Program at any time; accumulated diamonds above the minimum may be withdrawn at the next cutoff, subject to the holds in Section 4.
- The Platform may suspend or terminate your participation for breach. In cases of proven fraud, diamonds associated with the fraud are forfeited.
- Diamonds in deleted accounts, or accounts inactive for more than 12 months, may expire after prior email notice.
9. Transparency, restrictions, and complaints
(Section added 2026-08-20.)
Grounds on which we may restrict, suspend, or close a creator account. We act only on objective grounds, namely:
- Breach of this Agreement, of the Terms of Service, or of the Community Guidelines;
- Fraud or artificial activity in the gifts you received, as described in Section 4;
- Failure to complete the identity verification or to provide the tax documentation required by Sections 1, 5, and 7;
- An order from a competent authority, or a legal obligation binding on us;
- A genuine security risk to other users or to the Platform.
When we take any of these measures we tell you the specific reason by email, together with how to challenge it. Except where a legal obligation, an ongoing fraud investigation, or a security risk applies, the measure is communicated before it takes effect.
Advance notice of economic changes. Changes affecting your economic terms — tier percentages, the diamond conversion rate, withdrawal minimums and maximums, or fees — are announced at least 15 days in advance in the app or by email, the same minimum period that applies to any change to this Agreement under Section 12. This advance notice does not apply where the change is imposed by a legal obligation or is necessary to address an immediate security or fraud risk; in those cases we notify you as soon as possible.
Advance notice to end the relationship. Unless termination is due to a serious breach, fraud, an order from a competent authority, or an immediate security risk — cases where it may be immediate — the Platform will give at least 30 days' notice before ending your participation in the Program.
How a broadcast or profile is featured. The visibility of a broadcast or profile in discovery sections depends mainly on factors such as recent activity, gifts received, and compliance with the Community Guidelines; no single factor guarantees featuring, and their relative weight may vary to maintain discovery quality.
The Platform's own content. Wandvo does not publish or promote its own content in competition with Program creators.
Your activity data. Beyond the general access right in the Privacy Policy, you can view your gift history, your creator tier and applicable rate, and your withdrawal status in your Wallet.
Other channels. This Agreement is non-exclusive: nothing prevents you from broadcasting or posting the same content on other platforms.
Complaints. If you disagree with a restriction, with a hold, or with a change to the terms, you may file an internal complaint by emailing support@wandvo.app with your username and a description of what happened. We acknowledge receipt, a person reviews it, and we reply in writing with the reasons for the decision. This process is free of charge and does not limit your right to use the routes set out in Section 11, or any right granted to you by the law of your country.
10. Limitation of liability and indemnification
- The Program is provided "as is". To the maximum extent permitted by law, the Platform's total liability to the Creator is limited to the amount of duly credited pending payments.
- You agree to indemnify Wandvo against third-party claims arising from your content, your conduct, or your breach of this Agreement.
11. Governing law and disputes
- This Agreement is governed by the laws of the Commonwealth of Puerto Rico and applicable U.S. federal law.
- Disputes will first be addressed in good faith through in-app support; failing resolution, in the courts with jurisdiction in Puerto Rico.
12. Changes to this Agreement
The Platform may update this Agreement with at least 15 days' notice inside the app. Material changes require your re-acceptance; without it, you may withdraw your eligible balance but not continue accumulating.
